Welcome to Hisma Tours
This document constitutes a legally binding agreement between the “Company/Platform” and the “Client/Tourist.” By accessing our website or completing any booking through our platform, you explicitly acknowledge and agree to be bound by the terms and conditions outlined below, which are fully compliant with the regulations governing the tourism sector in the Kingdom of Saudi Arabia.
Booking Terms and Conditions
- A booking is considered confirmed only after the agreed amount or the down payment is paid.
- All provided data must be verified for accuracy before finalizing the booking.
- Prices only include the services outlined in the tour program and do not cover any unmentioned additional services.
- The client has the right to request booking modifications subject to service availability, and additional fees may apply.
- Cancellation and refund requests are subject to the specific cancellation policy of the program or the service providers.
- The client is not entitled to a refund if the cancellation is made 24 hours or less prior to the scheduled tour or service.
- Flight tickets, visas, and travel insurance are subject to the terms of their issuing entities and may be non-refundable after issuance.
- The company is not liable for any delays or cancellations caused by airlines or circumstances beyond control (Force Majeure).
- The client is obligated to carry valid travel documents and verify their validity before the tour date.
- The company reserves the right to make necessary modifications to the program due to operational or emergency circumstances, while providing appropriate alternatives.
- Finalizing the booking constitutes the client's full acceptance of all the terms and conditions mentioned.
1. Key Definitions
- The Company/Platform: Refers to “Hisma Tours,” its website, affiliated tour guides, and operational partners.
The Client/Tourist: Refers to the individual initiating the booking, including all accompanying persons within the same package or itinerary.
The Package/Tour Program: The combined set of services provided (e.g., transportation, accommodation, meals, guiding) as specifically detailed on the respective tour page.
2. Booking Policies and Confirmation
Eligibility: The lead booking person must be at least 18 years of age and possess the legal capacity to make authorized financial transactions.
Data Accuracy: The Client is solely responsible for the accuracy of all information provided during the booking process (e.g., names matching passports, dates of birth, contact details). The Company accepts no liability or additional fees arising from incorrect data entry.
Final Confirmation: No preliminary booking is considered valid. A booking is only finalized upon the Client receiving an official “Booking Confirmation” email containing the booking reference number and financial receipt.
3. Pricing, Taxes, and Surcharges
Transparency and VAT: In strict compliance with the Saudi Ministry of Tourism regulations, all prices displayed on the platform are final and inclusive of a 15% Value Added Tax (VAT). There are no hidden fees.
Exclusions: Package prices do not include international airfare, tourist visa issuance fees, medical/travel insurance, or any personal requests outside the approved itinerary (e.g., extra meals, private beverages, or hotel laundry services) unless explicitly stated.
Currency & Fluctuations: To facilitate our international clients, prices are displayed in Saudi Riyals (SAR), Euros (EUR), and US Dollars (USD). The Company reserves the right to adjust the prices of unpaid packages in the event of sovereign tax changes or severe currency exchange rate fluctuations.
4. Payment and Installment Policy

5. Cancellation and Refund Policy ( By the Client )
30 Days or More Prior to Departure: Full refund, minus any banking transaction fees and an administrative charge not exceeding 5% of the total booking value.
15 to 29 Days Prior to Departure: A 30% deduction from the total booking value; the remainder will be refunded.
7 to 14 Days Prior to Departure: A 50% deduction from the total booking value.
Less Than 7 Days (or No-Show): A 100% deduction applies. The Client is not entitled to any financial refund due to pre-committed operational costs.
Important Note: Issued domestic flight tickets or specific event passes registered under the Client’s name are strictly non-refundable regardless of the cancellation timeframe.
6. Modification or Cancellation ( By the Company )
- Force Majeure: Hisma Tours reserves the right to alter itineraries or cancel tours entirely in cases of extreme emergencies (e.g., severe weather conditions, natural disasters, road closures, or sudden governmental decrees) to ensure the utmost safety of our clients.
- Minimum Group Requirements: Certain tours require a minimum number of participants. If this threshold is not met 7 days prior to departure, the Company reserves the right to cancel the tour, offering the Client a suitable alternative or a full refund.
- Compensation Limits: In the event of a Company-initiated cancellation, our liability is strictly limited to the full refund of amounts paid directly to us. We are not responsible for any external costs incurred by the Client (e.g., international flights, visa fees).
7. Insurance and Health Requirements
Comprehensive Insurance: We highly recommend that all clients obtain comprehensive travel insurance covering emergency cancellations, personal accidents, medical evacuation, and lost luggage. The Platform does not directly provide insurance services.
Physical Fitness: Certain desert and mountain trails require a moderate to high level of physical fitness. It is the Client’s responsibility to ensure their physical capability and to disclose any chronic illnesses, allergies, or mobility impairments prior to booking, allowing us to provide appropriate accommodations where feasible.
8. Code of Conduct and Legal Compliance
- Respecting Local Laws: The Client agrees to fully abide by the laws and regulations of the Kingdom of Saudi Arabia. This includes adherence to public decorum and modest dress codes in public spaces and religious sites.
- Guide’s Authority: For the safety and smooth operation of the group, the Tour Guide’s instructions are binding once the tour commences. The Company reserves the right to exclude any Client exhibiting aggressive behavior or posing a risk to themselves or the group, without any obligation for a refund.
9. Baggage and Personal Belongings
The Client maintains sole responsibility for their luggage and valuable personal belongings (e.g., cameras, smartphones, jewelry) throughout the entire duration of the tour.
Hisma Tours legally and financially disclaims any liability for the loss, theft, or damage of personal items during transit or while situated at accommodations and tourist sites.
10. Special Requests and Dietary Needs
- We strive to accommodate special requirements (e.g., vegetarian, gluten-free meals, or accessibility needs).
- Such requests must be submitted in writing during the booking process. While we make every effort with our operational partners to fulfill them, we cannot guarantee their availability in remote desert camps or isolated destinations.
11. Media and Photography Policy
Company representatives or authorized photographers may capture photos and videos during the tours for promotional purposes. Participation in the tour implies your consent to be featured in such media.
If a Client wishes to opt out and maintain total privacy, they must explicitly inform the Tour Guide or expedition leader prior to the tour’s commencement.
12. Complaints and Feedback Mechanism
- We are committed to delivering a flawless luxury experience. Should a Client encounter any operational shortcomings during the trip, they must immediately notify the Tour Guide to allow for prompt on-site resolution.
- If the issue remains unresolved, an official written complaint must be submitted to our customer service email within a maximum of 14 days following the tour’s conclusion. Complaints filed after this period will not be entertained.
13. Governing Law and Dispute Resolution
This agreement, in its entirety, shall be governed by and construed in accordance with the laws of the Kingdom of Saudi Arabia. Any dispute arising from these terms shall initially be sought to be resolved amicably. Failing such resolution, the dispute shall be subject to the exclusive jurisdiction of the competent courts within the Kingdom of Saudi Arabia.
